The negotiation with POSCO International broke down late 2015. The 2015 visit team came back with the land transfer contract (called "Agreement Bond") showing DAEWOO International as the acquiring party and yet POSCO's Director CHOI Jongbin insisted that it was the Myanmar government, not DAEWOO, that acquired the lands. It has been determined that a lawsuit against the Myanmar government under military rule would have been futile (see previous postings). The only reasonable chance of recovery would have been through a lawsuit against POSCO International in a Korean court of law.
The lawsuit was filed in March 2016 in Seoul Central District Court against DAEWOO International.
In October 2017, the Clinic made its 7th fact-finding visit for this litigation and 3rd and final visit to Kyuakphyu Island to interview the farmers who suffered damage to the paddy fields due to the soil disposal from the gas facilities and were given separate compensation in October 2015 after the Clinic's 2nd fact-finding visit to the region.
